የኢፌዲሪ ህገ-መንግስት አንቀፅ 19 (6) ስለተያዙ ሰዎች መብት ሲደነግግ የተያዙ ሰዎች በዋስ የመፈታት መብት እንዳላቸው ሆኖም በህግ በተደነገጉ ልዩ ሁኔታዎች ፍርድ ቤት ዋስትና ላለመቀበል ወይም በገደብ መፍታትን ጨምሮ በቂ የሆነ የዋስትና ማረጋገጫ እንዲቀርብ ለማዘዝ እንደሚችል በግልፅ ተመልክቷል፡፡ ከዚህ ህገ-መንግስታዊ ድንጋጌ መረዳት የሚቻለው የዋስትና መብት መርህ (Principle) ሲሆን በዋስ አለመፈታት ደግሞ ልዩ ሁኔታ (Exception) መሆኑን ነው፡፡ ይህንን ህገ-መንግስታዊ ድንጋጌ ለማስፈፀም ተግባር ላይ ያለው የወ/መ/ስ/ስ/ህግ ምዕራፍ 3 ላይ የዋስትና ወረቀት አስፈርሞ ስለመልቀቅ የሚል ርዕስ ያለው ሲሆን በቁጥር 63 ላይ የዋስትና ወረቀት የሚያሰጡ መሰረታዊ ፍሬነገሮችን ይዘረዝራል፡፡ እነዚህ ፍሬነገሮች ዋስትና የሚያሰጡ ሁኔታዎችን የሚያስረዱ ቢሆንም በተቃራኒው በህግ አተረጓጎም መሰረት ዋስትና የሚያስከለክሉ ሁኔታዎችንም በውስጡ አካቶ ይዟል፡፡

The police as one part the executive organ of government, has its own obligations towards human rights. These include the obligation to respect and protect human rights. And police officers have also a direct and day-to-day contact with the entire society, which requires an enormous effort and patience of police officers to respect and protect human rights.
